Is the EIN process different in each state?
No. The EIN is a federal number issued by the IRS, and Form SS-4 is the same whichever state your LLC was formed in. What changes is the information on the SS-4 — your LLC’s exact legal name, state of organization and entity type must match your state formation filing.
Which state should I form my LLC in?
That is a legal and tax decision we don’t advise on — speak to a formation provider, lawyer or accountant. Once your LLC exists in any state, we can prepare and file its EIN application.
Do I also need a state tax ID?
Possibly. An EIN is federal. Depending on your business activity, the state where you operate may require separate registrations, such as for sales tax or payroll. Those are handled with the state, not the IRS.
